1. Introduction
The Bondwards Loyalty Program (the “Program”) is operated through the Bond Digital Platform by Elaqa for Design Services LLC, a company established in the United Arab Emirates (the “Company”, “we”, “our” or “us”).
Bond is the brand under which the Bond Digital Platform, services and related features are provided.
The Bond Digital Platform includes the website, mobile software, digital interfaces and related services through which eligible users may participate in the Program.
By creating or maintaining a Bond account, using the Bond Digital Platform or participating in the Program, you (“User”, “you” or “your”) agree to these Bondwards Loyalty Program Terms & Conditions (the “Terms”).
These Terms form part of the terms applicable to your use of the Bond Digital Platform and should be read together with the Bond Terms of Use, Bond Terms of Sales, Bond Privacy Policy and other applicable Bond terms and policies.
The earning methods currently available, and the amounts, caps and limits that apply to them, are published in the Bondwards section of the Bond Digital Platform. They are not set out in these Terms and do not form part of them, so that the Company can adjust them as the Program develops.
The Company may change those amounts, caps and limits at any time. A change applies prospectively only and does not reduce Bondwards already credited to your account.
If you do not agree to these Terms, you must not participate in the Program.
The Program is offered globally, subject to applicable local laws and any mandatory consumer or other legal rights that cannot lawfully be excluded or limited.
2. Definitions
For the purposes of these Terms:
Bondwards: the loyalty points that may be credited to an eligible User’s Bond account in accordance with the Program.
Bondwards are promotional loyalty points created solely for use within the Program.
Eligible User: an individual or business user who:
has a valid Bond account
is eligible to use the relevant Bond Digital Platform features
is not suspended or terminated
satisfies any additional eligibility requirements applicable to a particular earning or redemption activity
Certain Bondwards earning and redemption opportunities may be available only to individual consumer accounts or only to business accounts, as specified in these Terms or the relevant reward conditions.
B2C Services: Bond products and services intended primarily for individual consumers, including Bond Gold, Bond Silver and eligible Boosters, or such successor products as may be introduced by the Company.
B2B Services: Bond products and services intended primarily for professionals, businesses and enterprises, including Venue Analytics and Ads Manager, or such successor products as may be introduced by the Company.
B2C Bondwards: Bondwards earned through activities designated as eligible for B2C rewards.
B2B Bondwards: Bondwards earned through activities designated as eligible for B2B rewards.
Claim: a request by a User to apply eligible Bondwards toward an available reward.
Reward: a product, service, credit, benefit, access period, promotional benefit or other benefit that may be obtained using Bondwards.
Eligible Transaction: a transaction expressly identified by the Company as qualifying for Bondwards.
Churn: the termination, expiration without renewal or qualifying prolonged inactivity of a relevant subscription or account activity, as specified in these Terms or the applicable reward rules.
3. General principles of the Program
The Program operates as a promotional loyalty programme and does not create a monetary account, bank account, deposit, stored-value account or payment instrument.
The Program does not create ownership rights or a monetary claim against the Company.
Bondwards:
have no cash or redemption value outside the Program
cannot be exchanged directly for cash
cannot be withdrawn
cannot be transferred between Users
cannot be sold or commercially resold
cannot be pledged, assigned or used as security
cannot be independently purchased from the Company unless expressly stated otherwise
may only be redeemed in accordance with these Terms and the applicable Reward conditions
Participation in the Program is free unless a particular method of earning Bondwards requires a purchase or paid Bond service.
The Company may establish different earning rates, reward categories, limits and promotional campaigns for different User types, markets, products or periods.
The Company is not required to make every earning method or Reward available in every country or to every User.
The Program, and individual earning methods and Rewards, are made available progressively and at the Company's discretion, and certain features described in these Terms may not yet be available.
4. Reference value and redemption framework
Bondwards do not have a fixed monetary value.
For certain Program calculations, the Company may use a reference ratio between Bondwards and a maximum applicable Reward credit. Where such a ratio is used, it is published in the Bond Digital Platform.
Any such ratio is a reference mechanism only and does not mean that:
Bondwards constitute cash
a User owns a monetary amount corresponding to a Bondwards balance
Bondwards can be exchanged for currency
the Company owes a monetary amount corresponding to a User’s Bondwards balance
every Reward will provide a redemption value equal to the reference ratio
The actual benefit obtainable through Bondwards depends on the Reward, applicable redemption limits, availability and the conditions displayed at the time of redemption.
The Company may modify earning rates, Reward requirements, redemption ratios and other Program mechanics prospectively, subject to applicable law and Section 10 of these Terms.
5. Earning Bondwards
Bondwards may be earned through the activities described below.
The Company may introduce, discontinue or modify individual earning mechanisms in accordance with these Terms.
Unless otherwise stated, earning opportunities are subject to fraud-prevention controls, account eligibility requirements and any applicable monthly, transaction or User limits.
The activities described below are examples of ways in which Bondwards may be earned. They are not an exhaustive list. The Company determines which earning methods are available at any time, and an activity described in this Section accrues Bondwards only while it is shown as available in the Bond Digital Platform.
The amounts, caps and conditions that apply to each available earning method are published in the Bondwards section of the Bond Digital Platform, as described in Section 1.
5.1 Account registration
An eligible individual User may receive a registration bonus upon successful account creation and completion of any required verification.
The registration bonus:
may be granted only once per eligible User
may be subject to account or identity verification
may not be claimed through multiple accounts
may be withheld where the Company reasonably suspects duplicate accounts, fraud or abuse
The Company may restrict this earning method by country, account type or promotional period.
5.2 Referral Program
Eligible Users may earn Bondwards by inviting new users to join the Bond Digital Platform.
Unless otherwise stated in the applicable referral campaign, Bondwards may be earned on two distinct qualifying events:
when the referred User completes a first qualifying session on the Bond Digital Platform, in which case both the referring User and the referred User may receive Bondwards
when the referred User subsequently completes a first qualifying paid action meeting the applicable minimum amount, in which case the referring User may receive Bondwards
The amount applicable to each event is published in the Bond Digital Platform. No Bondwards are earned for sending an invitation.
The applicable paid action must be a genuine qualifying transaction and must not be cancelled, refunded, reversed or identified as fraudulent.
Referral limits and safeguards
maximum 10 qualifying referrals per User per calendar month
self-referrals are prohibited
referrals between duplicate, controlled or fraudulent accounts are prohibited
purchased, fake or misleading referrals are prohibited
automated or artificially generated referrals are prohibited
the Company may withhold or reverse Bondwards associated with ineligible or fraudulent referrals
The Company may introduce additional referral-specific terms for individual referral campaigns.
5.3 Bond Digital Platform usage
Eligible B2C Users may earn Bondwards for sustained active usage of the Bond Digital Platform, measured in series of consecutive qualifying days. The length of a qualifying series, the applicable amount and the monthly maximum are published in the Bond Digital Platform.
A series that is not completed does not earn Bondwards, and a day that does not qualify interrupts the series in progress.
For this purpose, “active usage” means accessing the Bond Digital Platform and completing at least one qualifying and measurable activity designated by the Company.
Simply opening or launching the Bond Digital Platform without performing the required qualifying activity may not constitute active usage.
The Company may use technical, security and anti-abuse controls to determine whether activity is genuine and qualifying.
5.4 Paid Bond Services
Bondwards may be earned in connection with eligible paid Bond Services.
The applicable earning rate is based on the eligible amount actually paid and retained by the Company, excluding amounts that are refunded, reversed, cancelled or otherwise determined not to qualify.
(a) B2C Subscriptions
Bondwards may be earned on eligible B2C subscriptions, including Bond Gold and Bond Silver, at the rate published in the Bond Digital Platform.
Earning rates apply to the eligible amount paid, or to the equivalent local-currency amount calculated using the currency conversion methodology applied by the Company.
Any additional bonus or multiplier applicable to a particular subscription period is as published with the applicable offer in the Bond Digital Platform.
B2C Bondwards earned from B2C Services are eligible only for Rewards designated as B2C Rewards unless the Company expressly states otherwise.
(b) B2C Boosters
Bondwards may be earned on eligible B2C Boosters at the rate published in the Bond Digital Platform.
B2C Bondwards earned from Boosters may be redeemed only against Rewards designated as B2C Rewards unless expressly stated otherwise.
(c) B2B Venue Analytics
Bondwards may be earned on eligible B2B Venue Analytics subscriptions or purchases at the rate published in the Bond Digital Platform.
B2B Bondwards earned from Venue Analytics may be redeemed only against Rewards designated as B2B Rewards unless expressly stated otherwise.
(d) Ads Manager
Bondwards may be earned on eligible Ads Manager spend at the rate published in the Bond Digital Platform.
Volume or campaign-specific bonuses may apply where expressly stated in the applicable commercial offer.
B2B Bondwards earned through Ads Manager may be redeemed only against Rewards designated as B2B Rewards unless expressly stated otherwise.
Eligible spend
For the purposes of this Section, eligible spend generally excludes:
taxes
refunds
chargebacks
cancelled transactions
reversed transactions
disputed amounts
promotional amounts not actually paid by the User
amounts expressly excluded from the applicable offer
The Company may define additional eligibility criteria for specific products or markets.
5.5 Events published
Eligible Users may earn Bondwards for each approved event published, subject to a maximum of 10 qualifying events per calendar month.
An eligible event must:
be genuine
be sufficiently unique
contain materially accurate information
comply with Bond policies
not be created solely to generate Bondwards
not constitute spam, duplication or manipulation
The Company may review, reject or reverse Bondwards associated with events that do not satisfy these requirements.
5.6 Verified visits to Bond Partner Venues
Where the Company makes this earning method available, eligible B2C Users may receive Bondwards for each verified qualifying visit to a Bond Partner Venue. The applicable minimum continuous presence, earning rate and monthly maximum are published in the Bond Digital Platform.
Verification may use location, device, venue, timing, account, behavioural or other technical signals.
The Company may use anti-fraud controls to determine whether a visit is genuine.
A visit may not qualify where the Company reasonably determines that the User:
did not physically attend the relevant Venue
manipulated location data
used a technical method to falsify presence
generated repeated or artificial visits
otherwise attempted to circumvent the Program rules
A Partner Venue may, where expressly authorised by the Company, fund or provide additional promotional Bondwards.
Any additional Partner-funded bonus will be subject to the conditions displayed with the relevant promotion.
5.7 Discovering Venues around you
Eligible B2C Users may receive Bondwards for a qualifying session in which the Bond Digital Platform displays Bond Venues located around them. The applicable amounts and conditions are published in the Bond Digital Platform.
A session qualifies where the User opens the relevant feature of the Bond Digital Platform and Venues located around the User are actually displayed to the User.
Bondwards are not granted in consideration for giving a consent. This earning method rewards the use of a feature of the Bond Digital Platform. Where that feature depends on a permission granted at device or account level, such as location services, the Bondwards reward the use of the feature and not the granting of the permission.
You may grant, refuse or withdraw any such permission at any time. Refusing or withdrawing a permission does not affect Bondwards already credited to your account, and the Company does not withdraw Bondwards already credited to you because a permission has subsequently been withdrawn.
Where a permission required for a feature has not been granted, the feature and the corresponding earning method are simply unavailable to you. Information on how the Company processes location data, and on the lawful basis on which it does so, is set out in the Privacy Policy.
6. Behavioural and loyalty bonuses
The Company may award additional Bondwards for sustained engagement or other qualifying behaviours.
Examples include:
Two consecutive qualifying subscriptions
This bonus may apply when a User maintains two consecutive qualifying paid subscription periods without an intervening cancellation or other disqualifying event.
Three months of continuous qualifying activity
The User must maintain qualifying activity throughout the applicable three-month period.
Six months without Churn
A User may qualify where all applicable conditions in Section 6.1 are satisfied.
User birthday
A birthday bonus may be awarded once per calendar year where the User has provided a valid date of birth and satisfies any applicable verification requirements.
The Company may impose reasonable safeguards to prevent repeated changes to a User’s date of birth for the purpose of obtaining additional rewards.
6.1 Six months without churn
A User qualifies for the six-month loyalty bonus when all applicable conditions below are satisfied:
For qualifying subscription Users
no qualifying paid subscription expires without renewal beyond any applicable grace period
the User maintains an active Bond account
the User satisfies any minimum activity requirement applicable to the relevant subscription
the account is not suspended or terminated
the User has not voluntarily closed the account
For qualifying Ads Manager Users
at least one qualifying advertising spend activity occurs during each applicable 30-day period
the business account remains active
the account is not suspended or terminated
General requirement
A qualifying User must not have engaged in fraud, abuse or manipulation of the Program.
The six-month bonus may be granted once per qualifying six-month period unless otherwise stated in a promotional campaign.
The Company may define additional qualifying conditions for specific products or User types.
7. Redeeming Bondwards
7.1 General rules
Bondwards may be redeemed only for Rewards expressly made available by the Company.
Unless otherwise stated:
Bondwards:
cannot be redeemed for cash
cannot be transferred
cannot be sold
cannot be withdrawn
cannot be used outside the Bond Digital Platform
cannot be redeemed above the maximum permitted percentage or amount applicable to the relevant transaction or Reward
Unless otherwise stated for a particular Reward, Bondwards may not be used to cover more than:
20% of the eligible value of a qualifying transaction
The “eligible value” excludes taxes, gratuities, service charges and other amounts that are not expressly designated as eligible for Bondwards redemption.
The Company may apply lower limits to particular Rewards, Products, markets, account types or promotional campaigns.
Rewards may be subject to:
availability
geographic restrictions
time limits
eligibility requirements
redemption caps
product-specific conditions
minimum purchase requirements
A Reward must be accepted by the User in accordance with the conditions presented at the time of redemption.
7.2 B2C Rewards
Subject to availability, B2C Bondwards may be redeemed against Rewards including:
free or discounted Boosters
temporary Bond Silver or Bond Gold access
limited-time upgrades
other consumer benefits expressly designated as B2C Rewards
The Company may add, remove or modify B2C Rewards from time to time.
7.3 B2B Rewards
Subject to availability, B2B Bondwards may be redeemed against Rewards including:
advertising credits
a discount on an invoice for sponsored or enhanced visibility, for Venue Analytics or for another B2B Bond service, within the discount limit published in the Bond Digital Platform
other business benefits expressly designated as B2B Rewards
B2B Rewards may be subject to additional commercial terms, eligibility requirements, minimum spend requirements or contractual conditions.
7.4 Redemption process
The Company may require a User to:
select a Reward
confirm the number of Bondwards to be used
satisfy the applicable eligibility conditions
accept the relevant Reward terms
complete any qualifying purchase or transaction
confirm the redemption
Once a redemption has been successfully completed, the corresponding Bondwards will normally be deducted from the User’s balance.
Unless otherwise stated, redeemed Bondwards cannot be reinstated because the User subsequently decides not to use the Reward.
Where applicable law provides a mandatory cancellation, refund or withdrawal right, that right remains unaffected.
8. Expiration of Bondwards
Unless otherwise stated in the applicable Reward or promotional terms, Bondwards expire after:
18 consecutive months of account inactivity
For this purpose, qualifying account activity includes earning or redeeming Bondwards or another activity designated by the Company as resetting the inactivity period.
The Company may display or notify Users of the applicable inactivity period and upcoming expiry where required by applicable law.
Expired Bondwards cannot normally be reinstated.
Where mandatory law requires a different treatment, the applicable law prevails.
Closing or termination of a Bond account may result in the cancellation of accumulated Bondwards, subject to applicable law.
9. Fraud, abuse and Program integrity
The Program is designed for genuine participation.
Fraudulent, deceptive, manipulative or abusive conduct is prohibited.
Examples include:
creating or controlling multiple accounts for the purpose of earning additional Bondwards
self-referrals
fake or automated referrals
falsifying location or visit information
creating duplicate or artificial events
exploiting technical vulnerabilities
using bots, scripts or other automated mechanisms to generate Bondwards
manipulating transactions
using refunds or chargebacks to retain Bondwards
selling or transferring Bondwards
attempting to circumvent earning or redemption limits
any other conduct intended to obtain an unfair Program benefit
Where the Company reasonably believes that Bondwards were obtained or used improperly, the Company may:
withhold pending Bondwards
cancel or reverse Bondwards
reject a Reward Claim
suspend Program participation
suspend or terminate the Bond account
restrict access to particular Program features
take other action permitted by applicable law
Where reasonably appropriate, the Company may provide an explanation or review mechanism for material account actions.
Nothing in this Section limits mandatory legal rights available to the User.
10. Modification, suspension or termination of the Program
The Company may modify, suspend or terminate all or part of the Program where reasonably necessary, including to:
comply with applicable laws or regulations
introduce or discontinue features
change the Bond product offering
prevent fraud or abuse
address technical or operational requirements
change commercial or loyalty strategies
protect the integrity of the Bond Digital Platform
respond to market or business conditions
The Company may modify earning rates, bonus structures, Reward availability, redemption limits, redemption ratios and other Program mechanics prospectively.
Where a change materially reduces the benefit of already-accrued Bondwards, the Company will provide reasonable notice and, where required by applicable law, preserve applicable rights or provide another legally required remedy.
The Company will not intentionally apply a material reduction to already-accrued Bondwards retroactively where such retroactive change is prohibited by applicable law.
If the Program is terminated permanently, the Company may provide a reasonable period during which eligible Bondwards can be redeemed, where commercially and legally appropriate.
Nothing in this Section limits any mandatory legal rights.
11. Account suspension, termination and Bondwards
If a User voluntarily closes their Bond account, the User may lose all accumulated Bondwards associated with that account, subject to applicable law.
If the Company suspends or terminates an account because of fraud, abuse, unlawful conduct or material breach of the applicable Bond terms, the Company may cancel some or all Bondwards associated with that account, to the extent permitted by law.
If an account is suspended temporarily, the Company may also suspend the User’s ability to earn or redeem Bondwards during the suspension period.
Bondwards do not survive the permanent closure of an account unless otherwise required by applicable law or expressly stated by the Company.
12. No cash value and no financial product
Bondwards are promotional loyalty points only.
They are not:
cash
currency
electronic money
a bank balance
a stored-value account
a deposit
a security
an investment
a financial instrument
a debt or receivable owed by the Company
Bondwards do not accrue interest.
The User does not acquire ownership of any cash reserve or underlying monetary asset by earning Bondwards.
The Company may change the available Rewards and redemption mechanics in accordance with these Terms and applicable law.
13. Limitation of liability
To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential or punitive losses arising from the Program, including loss resulting from:
temporary unavailability of the Program
technical interruptions
delayed crediting of Bondwards
failure of a particular earning mechanism
changes to Reward availability
expiry of Bondwards in accordance with these Terms
loss of Bondwards caused by a User’s failure to protect account credentials
suspension or termination resulting from a User’s breach of applicable terms
The Company will use reasonable efforts to maintain accurate Program records but does not guarantee that the Program will always be uninterrupted or error-free.
Where liability relating specifically to Bondwards cannot lawfully be excluded, the maximum recoverable amount will be determined in accordance with applicable law and, where legally permitted, will not exceed the maximum applicable redemption benefit directly associated with the Bondwards giving rise to the claim.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
14. Governing law and mandatory local rights
These Terms are governed by and construed in accordance with the laws of the Dubai International Financial Centre (“DIFC”), United Arab Emirates, except to the extent that mandatory laws of the jurisdiction in which you reside apply and cannot lawfully be excluded.
Nothing in these Terms is intended to deprive you of mandatory consumer rights, statutory protections or other rights that apply to you and cannot legally be waived.
Where applicable law gives you the right to bring proceedings in your country or place of residence, that right remains unaffected.
Any court, arbitration or dispute-resolution provision applicable to the Program applies only to the extent permitted by applicable law.
15. Changes to these Terms
The Company may update these Terms from time to time to reflect:
changes to the Program
new or discontinued earning mechanisms
new or discontinued Rewards
changes to the Bond Digital Platform
legal or regulatory requirements
security requirements
changes in business practices
If a change materially affects your rights or obligations, the Company will provide notice in accordance with applicable law and, where appropriate, through the Bond Digital Platform, email or another reasonable communication method.
The version of these Terms applicable to your participation will be the version in effect at the relevant time, subject to any rights or protections that cannot legally be changed retrospectively.
16. Contact
Questions regarding the Bondwards Loyalty Program may be submitted through the support or contact channel made available through the Bond Digital Platform or on the website.
When contacting support about Bondwards, Users should provide sufficient information to allow the Company to identify the relevant Bond account and Program activity.
