1. Applicability
By purchasing any digital Bond product or service (a “Product”) offered by Elaqa for Design Services LLC, a company established in the United Arab Emirates (the “Company”, “we”, “our” or “us”), or by carrying out a purchase or transaction through the Bond website or Bond Digital Platform, you agree to these Terms of Sales.
The Company may use third-party payment providers, app stores and other authorised payment platforms to process purchases.
Where a purchase is processed through Apple App Store, Google Play or another third-party platform, the applicable platform terms, payment procedures and refund mechanisms may also apply.
The Company may verify information before processing a purchase and may refuse, suspend or cancel a purchase where reasonably necessary to comply with applicable law, prevent fraud or address suspected misuse.
Nothing in these Terms limits mandatory consumer rights applicable in your jurisdiction.
2. Purchases and subscriptions
Bond may offer Products for purchase directly through the Bond Digital Platform or through authorised third-party payment platforms.
Before completing a purchase, you will be shown the applicable Product, price, currency, taxes where applicable, billing frequency and material purchase conditions.
Where a Product is purchased through a third-party platform, that platform may process the payment and may apply its own terms.
If a Product is sold as a recurring subscription, the subscription may automatically renew unless cancelled before the applicable renewal date.
The applicable renewal date, frequency, price and cancellation process will be disclosed before or at the time of purchase.
Where applicable law requires additional notice, confirmation or consent before automatic renewal, the Company will provide and obtain the applicable requirement.
If a payment fails, you remain responsible for legitimate amounts due under the applicable subscription, subject to applicable law and the applicable payment-provider terms.
Boosters, Bondwards and other in-app items
From time to time, you may be able to purchase or earn a limited, personal, non-transferable, non-sublicensable, revocable licence to use in-app items made available through the Bond Digital Platform. These items include Boosters, Bondwards and any other virtual product, unit or credit that the Company may make available for use within the Service (collectively, the “In-App Items”).
Bondwards are also subject to the Bondwards Loyalty Program Terms & Conditions, which govern how they are earned, redeemed and expire.
Any In-App Item balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your licence.
In-App Items do not incur fees for non-use, however, the licence granted to you in In-App Items will terminate in accordance with the terms of this Agreement, when the Company ceases providing the Service or your account is otherwise closed or terminated.
The Company, in its sole discretion, reserves the right to charge fees for the right to access or use In-App Items and may distribute In-App Items with or without charge.
The Company may manage, regulate, control, modify or eliminate In-App Items at any time. The Company shall have no liability to you or any third party in the event that the Company exercises any such rights. In-App Items may only be redeemed through the Service.
Subject to mandatory consumer rights applicable to you and to Section 5 of these Terms of Sales, purchases and redemptions of In-App Items made through the Service are final and non-refundable.
The provision of In-App Items for use in the Service is a service that commences immediately upon the acceptance of your purchase of such In-App Items.
Except where applicable law provides otherwise, the Company is not required to provide a refund in respect of In-App Items, and you will not receive money or other compensation for unused In-App Items when an account is closed, whether such closure was voluntary or involuntary.
3. Termination and cancellation
You may cancel your Bond subscription through the cancellation mechanism provided by the Bond Digital Platform or, where applicable, through the relevant third-party payment platform.
Deleting the Bond Digital Platform from your device does not by itself cancel a subscription purchased through a third-party payment platform.
When you cancel a subscription, you will generally retain access to the paid features until the end of the applicable paid period unless applicable law requires otherwise.
After the applicable paid period ends, the subscription will not renew and your account may revert to free access where such functionality is available.
The Company may suspend or terminate access where reasonably necessary because of fraud, unlawful activity, serious misuse of the Service or material breach of these Terms, subject to applicable law.
Where applicable law requires a refund, notice, cure period or other protection following suspension or termination, those requirements apply.
4. Free trial
From time to time, Bond may offer a free trial or other introductory period for selected Products.
Unless otherwise stated at the time of the offer:
- you may be eligible for only one free trial for a particular Product
- the duration of the free trial will be displayed before or when you start the trial
- if the trial converts to a paid subscription, the applicable price, renewal frequency and billing date will be disclosed before or at the start of the trial
- you may cancel the trial before the applicable conversion or renewal date using the cancellation method provided by Bond or the relevant payment platform
Where applicable law requires additional notice, confirmation or consent before a free trial converts to a paid subscription, the Company will provide and obtain the applicable requirements.
Where a trial is provided through Apple, Google or another third-party platform, the applicable platform billing and cancellation procedures may also apply.
The Company may limit trial eligibility where reasonably necessary to prevent fraud, abuse or repeated use of introductory offers.
5. Refunds, cancellation and statutory consumer rights
Unless otherwise required by applicable law or expressly stated at the time of purchase, subscription charges are generally non-refundable and no credit is provided for partially used subscription periods.
Nothing in these Terms excludes or limits mandatory consumer rights applicable to you.
Depending on your jurisdiction and the nature of the Product, you may have statutory rights relating to cancellation, withdrawal, refunds, conformity of digital content or digital services, price reductions, termination or other remedies.
Where a statutory withdrawal or cancellation period applies, the Company will provide the applicable cancellation and refund rights.
Where digital content or a digital service is supplied immediately after purchase and applicable law requires your express consent or acknowledgement concerning commencement of performance or loss of a withdrawal right, the Company will obtain the applicable consent or acknowledgement through the purchase flow.
Where a purchase is made through Apple, Google or another third-party platform, that platform’s refund process may also apply, subject to mandatory legal rights.
Refund requests for purchases made through the Apple App Store can be submitted at https://getsupport.apple.com, and for purchases made through Google Play at https://support.google.com/googleplay/.
Refunds, where applicable, will normally be made using the original payment method unless otherwise required by applicable law.
For subscribers and purchasers of In-App Items residing in the Republic of Korea – in accordance with local law, you are entitled to a full refund of your subscription and/or unused In-App Items during the 7 days following the purchase. Please note that this 7-day period commences upon the purchase.
Except as noted above for members resident in the Republic of Korea, and subject to mandatory consumer rights applicable to you, purchases of In-App Items are final and non-refundable.
You cannot cancel an order for delivery of digital content that is not delivered on a physical medium if order processing has begun with your explicit prior consent and acknowledgement that you will thereby lose your right of cancellation. This applies, for example, to purchases of In-App Items, which are then final and non-refundable to the extent permitted by applicable law.
6. Orders
When you attempt to purchase any Product or carry out any purchase or transaction through the Bond Digital Platform by clicking the “Buy" or equivalent option, this constitutes an offer to buy the Product and/or complete the purchase/transaction. Your purchase is not complete until we email you to confirm the transaction. We reserve the right to reject your offer and not conclude a sale agreement with you.
7. Pricing
The Company may offer different prices, currencies, subscription structures, promotional rates and payment methods depending on the country or region, distribution channel, Product, subscription period, bundle or other commercial factors.
The applicable price and currency will be displayed before you complete a purchase.
Applicable taxes, duties or similar charges may be added or included as required by local law.
Where local law requires prices to be displayed inclusive of tax or requires specific price disclosures, the Company will provide the applicable information at or before purchase.
The Company may correct genuine pricing or Product-description errors in accordance with applicable law.
8. Payment
You may only pay for Products purchased through the Bond Digital Platform using a valid credit or debit card or post pay service or any other payment method made available by the Company through the Bond Digital Platform. It is acknowledged and agreed that any payment made by you using a post pay service is an additional separate contractual arrangement between you and that service provider and subject to the terms and conditions of that provider.
9. Warranties and consumer rights
Except where otherwise required by applicable law, Products and digital services are provided in accordance with the applicable Product description and Service functionality presented at the time of purchase.
The Company does not guarantee that every Product or Service will be uninterrupted, error-free or suitable for every individual purpose.
Nothing in these Terms excludes or limits mandatory statutory warranties, conformity rights or other consumer protection applicable to you.
Where applicable law gives you a right to repair, correction, replacement, price reduction, termination, refund or another remedy in respect of defective or non-conforming digital content or digital services, those rights remain unaffected.
10. Limitation on liability
To the maximum extent permitted by applicable law, the Company, its affiliates, licensors and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from your purchase or use of a Product.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights or non-excludable liability.
Where a limitation of liability is permitted, the Company’s aggregate liability arising from a Product or purchase will not exceed the amount paid by you for the relevant Product during the twelve months preceding the event giving rise to the claim, subject to any greater protection required by applicable law.
11. Governing law and jurisdiction
These Terms of Sales are governed by and construed in accordance with the laws of the Dubai International Financial Centre (“DIFC”), United Arab Emirates, except to the extent that mandatory laws of the jurisdiction in which you reside apply and cannot lawfully be excluded.
Nothing in these Terms is intended to deprive you of mandatory consumer rights or statutory protections that apply to you.
Where applicable law gives you the right to bring proceedings in your country or place of residence, that right remains unaffected.
Any jurisdiction or dispute-resolution provision in these Terms applies only to the extent permitted by applicable law.
12. Limitation periods
Any limitation period applicable to a claim arising from or relating to these Terms is determined by the mandatory law applicable to the relevant claim.
Nothing in these Terms shortens a statutory limitation period where such a limitation cannot lawfully be shortened by agreement.
13. Waiver and severability
No waiver by the Company of any term or condition set forth in these Terms of Sale shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Sale shall not constitute a waiver of such right or provision.
If any provision of these Terms of Sale is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Sale will continue in full force and effect.
14. Entire agreement
These Terms of Sales, together with the Bond Terms of Use, Bond Privacy Policy, Bond Cookie Policy and any additional terms expressly disclosed and agreed to when purchasing a particular Product, constitute the agreement between you and the Company regarding the relevant purchase.
If a Product has specific purchase terms, those terms apply to the extent they do not conflict with mandatory applicable law.
Where a Product entitles you to Bondwards, the Bondwards Loyalty Program Terms & Conditions also apply to the Bondwards credited in respect of that purchase.
